3.1. Types of Commissions
The Affiliate may earn two types of commissions under this Program: Direct Commissions and Multi-Level (Override) Commissions.
3.2. Direct Commissions
Babelix will pay the Affiliate a commission for each referred user who, using the Affiliate’s valid referral links, completes any applicable free trial period and makes effective payments for a premium subscription on the Babelix platform, according to the following structure:
- First Payment Commission: The Affiliate will receive a commission equivalent to fifty percent (50%) of the net amount of the first premium subscription payment effectively charged to the referred user.
- Recurring Commission: For each subsequent premium subscription renewal payment effectively charged to the same referred user, the Affiliate will receive a commission equivalent to thirty percent (30%) of the net amount of said recurring payment. This recurring commission shall accrue if the referred user maintains an active and valid premium subscription (“Lifetime Commission”).
These commissions will be generated and recorded after Babelix successfully processes the referred user’s corresponding payment.
They will be subject to the validation periods and potential adjustments described in Clause 3.4. Commissions will only accrue for premium subscriptions that are paid in full. No commissions will be generated for free registrations, free trials that are not converted to paid status, or other actions that do not involve an eligible payment.
3.3. Multi-Level (Override) Commissions
In addition to Direct Commissions, Babelix operates a multi-level (Multi-Tier) commission system that allows the Affiliate to earn commissions based on sales generated by other affiliates (“Sub-affiliates”) within their recruitment network, up to a maximum of five (5) levels deep, according to the following structure:
- Level 1: Corresponds to the Direct Commissions generated by sales to users directly referred by the Affiliate, as described in Clause 3.2.
- Level 2: The Affiliate will receive an override commission equivalent to twelve percent (12%) of the direct commission amount (Level 1) earned by a Sub-affiliate directly recruited by the Affiliate.
- Level 3: The Affiliate will receive an override commission equivalent to eight percent (8%) of the direct commission amount (Level 1) earned by a Sub-affiliate located at the second level of their network (i.e., recruited by the Affiliate’s Level 1 Sub-affiliate).
- Level 4: The Affiliate will receive an override commission equivalent to five percent (5%) of the direct commission amount (Level 1) earned by a Sub-affiliate located at the third level of their network.
- Level 5: The Affiliate will receive an override commission equivalent to two percent (2%) of the direct commission amount (Level 1) earned by a Sub-affiliate located at the fourth level of their network.
These override commissions are calculated exclusively on the direct commission amount obtained by the Sub-affiliate of the corresponding lower level. They are subject to the same validation, payment, and adjustment conditions as Direct Commissions.
3.4. Limitations and Adjustments
No commissions (both Direct and Multi-Level) will be granted or paid in the following cases:
- Self-referrals or transactions made by the Affiliate themselves, their company, employees, agents, or any person or entity acting in collusion or agreement with the Affiliate to generate undue commissions. Subscriptions purchased by the Affiliate (or entities directly linked to them) through their own affiliate links will not qualify for commissions.
- Sales or subscriptions that are subsequently canceled, refunded within the period established by Babelix for such actions (considering trial periods and post-payment refund guarantees), subject to a bank chargeback, result from fraud (including, without limitation, credit card fraud), or are otherwise determined to be invalid or fraudulent according to these Terms. Babelix reserves the right to void or adjust commissions (“Reject”) in the event of returns, chargebacks, detected fraud (including payment fraud), or transaction invalidity. Commissions corresponding to these invalidated transactions will be deducted from amounts pending payment to the Affiliate or, if already paid, may be reclaimed by Babelix or deducted from future payments.
- Activities that violate these Terms and Conditions or the Program’s promotion guidelines. Suppose Babelix determines that any premium subscription was obtained through prohibited methods (including, but not limited to, spam, invalid traffic, deceptive advertising, or any method described in the Anti-Fraud Policy). In that case, Babelix will void the associated commissions and may take additional measures, including terminating the Affiliate’s account as detailed in the relevant section of these Terms.
3.5. Tracking and Responsibility
Upon acceptance into the Program, Babelix will provide the Affiliate with a unique Affiliate ID and/or specific referral links. The Affiliate is solely responsible for ensuring the correct use of these tracking links in all promotional media.
The Affiliate acknowledges that proper tracking depends on the correct implementation of the links and the use of technologies such as cookies (Babelix utilizes a “Last Click” attribution model). Babelix will employ commercially reasonable efforts to ensure tracking accuracy but will not be liable for lost commissions due to incorrect link implementation by the Affiliate, deletion of cookies by the end-user, use of tracking-blocking software, or technical failures beyond Babelix’s reasonable control.
